Pro Take: Federal Judges Disagree on Chapter 11 Releases

The Boy Scouts of America’s chapter 11 case has revealed disagreements within the federal judiciary about the outer limits of bankruptcy courts’ powers.

In upholding the youth group’s reorganization plan, U.S. District Judge Richard Andrews in Wilmington, Del., took an expansive view of bankruptcy jurisdiction and said that chapter 11 plans can extinguish creditors’ claims against third parties whenever necessary.
